(iii) In the event that Legal Counsel & Technical Solutions S.A.S. is unable to carry out the treatment by its own means, it may transfer the data collected to be processed by a third party, prior notification to the owners of the data collected, the which will be in charge of the treatment and must guarantee suitable conditions of confidentiality and security of the information transferred for the treatment. Rights of the Holders In accordance with the law: The Holders of Personal Data have the following rights: (i) Know, update and rectify the personal data before Legal Counsel & Technical Solutions S.A.S. as responsible or in charge of the treatment, or exercise the right against whoever has received the data as a result of the transmission of the same. This right may be exercised, among others, against partial, inaccurate, incomplete, fragmented, misleading data, or those whose treatment is expressly prohibited or has not been authorized; (ii) Request proof of the authorization granted to Legal Counsel & Technical Solutions S.A.S. as data controller except when expressly excepted as a requirement for processing; (iii) Be informed by Legal Counsel & Technical Solutions S.A.S. as data controller or data processor, upon request, regarding the use you have given to personal data; (iv) Submit complaints to the Superintendency of Industry and Commerce for violations of the personal data protection regime; (v) Revoke the authorization and/or request the deletion of the personal data when the constitutional and legal principles, rights and guarantees are not respected in the treatment; (vi) Free access to the personal data that has been processed. In this sense, the area in charge of the Treatment of Personal Data and the attention of queries and claims may be contacted from Monday to Friday from 8:00 AM to 12:00 M and 2:00 PM to 6:00 PM, through the email info@legalcotechsolutions.com. The procedure that will be followed for the exercise of the rights of the Holders will be the following: Consultations: (i) When the Holder of the Personal Data, his representative or successor in title requires to consult his Personal Data contained in the Legal Counsel & Technical Solutions Databases Associate S.A.S., Legal Counsel & Technical Solutions S.A.S. will respond to the query within the following ten (10) business days from the date of receipt of the query made. (ii) If it is not possible to attend the query within said term, the interested party will be informed, stating the reasons for the delay and indicating the date on which their query will be attended, which in no case may exceed five (5) days. working days following the expiration of the first term. Claims (i) The Holder, his representative or successor in title may request the correction, updating or deletion, presenting a claim which must be processed by means of a written request that contains the following information: i) Identification of the Holder, ii) Description of the facts that give rise to the claim, iii) Correspondence address of the Holder, iv) Documents supporting the request. (ii) If the application is incomplete, Legal Counsel & Technical Solutions S.A.S., or its area in charge, will require the interested party to provide the additional documents, within five (5) days following receipt of the claim. The interested party will have up to sixty (60) days to respond to the required information, in case of not responding it will be understood that he has withdrawn the claim. (iii) Once the claim is received, a note stating that there is a claim in progress must be included in the respective Database within two (2) days following its receipt. (iv) The claim must be addressed within fifteen business days following its receipt. If it is not possible to serve it within that term, the interested party will be informed, and the reasons for the delay will be informed, and a response will be given within a maximum term of eight (8) days. The exercise of the rights of the Holders may be carried out at any time. For the purposes of consulting Personal Data, they will be provided free of charge, under the terms of Decree 1377 of 2013. Information Security: Legal Counsel & Technical Solutions S.A.S. has adopted reasonable security measures to protect the information of the Owners and prevent unauthorized access to their data or any unauthorized modification, disclosure or destruction thereof. Access to personal data is restricted to those employees, contractors, representatives and agents of Legal Counsel & Technical Solutions S.A.S. in charge of data processing and who need to know the same to perform their functions and develop the corporate purpose of the entity. Legal Counsel & Technical Solutions S.A.S. does not allow access to this information by third parties under conditions other than those announced, except at the express request of the owner of the data or legitimate persons in accordance with national regulations. Notwithstanding the foregoing, Legal Counsel & Technical Solutions S.A.S. will not be responsible for computer attacks and in general any action that has the objective of infringing the security measures established for the protection of personal data and information other than those contained in its computer equipment or in those contracted with third parties. Changes in the Personal Data Protection and Treatment Policy: Legal Counsel & Technical Solutions S.A.S. reserves the right to make changes to this Policy. In accordance with the provisions of article 5 of Decree 1377 of 2013, when there are substantial changes, referring to the identification of the person in charge and the purpose of the treatment, which affect the content of the authorization, it will be necessary to communicate said changes to the Holder. In addition, a new authorization must be obtained from the holder when the change refers to the purpose of the treatment. 10. Validity This Policy for the Protection and Treatment of Personal Data is effective as of June 6 (06), 2017 and is in force. The Personal Data against which the Treatment is carried out in any of our Databases, will remain in them for the time necessary for the purposes mentioned in this Policy, and for which they were collected.
